Texas liquor law for a brewery taproom
The same dram shop standard that applies to bars applies to your taproom. Section 2.02 of the Alcoholic Beverage Code imposes liability when it was apparent that the person served was obviously intoxicated to the extent of presenting a clear danger to himself and others, and that intoxication proximately caused the damages. Section 2.03 makes that chapter the exclusive civil remedy for serving adults 18 and older. Flights feel low risk, but a guest who samples six high-gravity pours before driving is the fact pattern these suits are built on.
Seller-server certification through TABC is voluntary under state law and valid for two years, yet it is what unlocks the §106.14 safe harbor: when you require TABC-approved training, the employee attended, and you did not encourage the violation, the permit is protected from TABC administrative action for that employee’s illegal sale. It does not protect the brewery from a civil suit. Whether your permit class requires a liquor policy is a question to confirm with TABC; landlords, distributors and festival organizers commonly require evidence of insurance regardless.
Brewhouse, packaging and event risks
Production is where brewery losses get large. A glycol chiller fails over a holiday weekend and three fermenters of lager warm past saving. A relief valve on a brite tank sticks, and the release damages equipment and injures a cellar worker.
